Even if members of a Palestinian armed group were in the vicinity of the mosque prior to the attack, the officer should have cancelled the attack as soon as he learned of the presence of scores of civilians in and outside the mosque. Customary international humanitarian law requires an attacking force 'to do everything feasible to cancel or suspend an attack if it becomes apparent that the target is not a military objective or that the attack may be expected to cause incidental loss of civilian life, injury to civilians, damage to civilian objects, or a combination thereof, which would be excessive in relation to the concrete and direct military advantage anticipated'.
